Acceptance of Terms

By downloading, installing, or using the DiveKit mobile application ("the App"), you agree to be bound by these Terms of Service and End-User License Agreement (collectively, "this Agreement"). If you do not agree to this Agreement, do not use the App.

Parties to This Agreement

This Agreement is entered into between you ("End-User") and Ronny Majani ("we", "us", "our", "the Developer"), and not with Apple Inc., Google LLC, or any of their subsidiaries ("Platform Providers"). The Developer, not the Platform Providers, is solely responsible for the App and its content. This Agreement must be compliant with, and is subject to, the applicable Platform Provider's terms of service, including the Apple Media Services Terms and Conditions and the Google Play Terms of Service.

Description of Service

DiveKit is a dive planning toolkit that provides calculators, gas blending tools, and decompression planning features for scuba divers. The App is designed as a planning aid and reference tool.

License Grant

Subject to this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any device that you own or control, as permitted by the applicable Platform Provider's usage rules, including the Apple Media Services Terms and Conditions "Usage Rules." This license does not allow you to use the App on a device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

If you access the App through the Apple App Store, you may also access and use the App on other Apple-branded devices signed in to the same Apple ID, including shared access through Family Sharing or volume purchasing programs, subject to the applicable usage rules.

Important Safety Disclaimer

Scuba diving, including decompression diving, is an inherently dangerous activity that carries a risk of serious injury or death. DiveKit is a planning and reference tool only. It is NOT a substitute for proper dive training, certification, or professional judgment.

• Always dive within the limits of your training and certification.
• Never rely solely on any software — including this App — for dive safety decisions.
• All decompression planning outputs should be independently verified and cross-checked with other sources, including your dive computer and qualified instructors.
• The App does not replace a dive computer, proper training, or professional dive planning instruction.
• You are solely responsible for your own safety and the safety of your dive team while diving.
• Individual physiological responses to pressure, gas loading, and decompression vary and cannot be fully predicted by any model or software.

Assumption of Risk

By using the App, you acknowledge that scuba diving is a dangerous activity and that you voluntarily assume all risks associated with diving, including risks arising from the use of dive plans, calculations, or any other output generated by the App. You agree that you will rely on your own training, experience, and judgment — and not solely on the App — when making decisions related to dive safety.

Free and Premium Features

Most features in DiveKit are available free of charge. The Deco Planner is a premium feature available via subscription ($4.99/month, first month free) or lifetime purchase ($24.99). Subscriptions are managed through the Apple App Store or Google Play Store and are subject to their respective terms.

Subscriptions and Billing

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Payment is charged to your Apple ID or Google account at confirmation of purchase.
• You can manage or cancel subscriptions in your device's account settings.
• Refunds are handled by Apple or Google according to their policies.

Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services for the App, as specified in this Agreement or as required under applicable law. You acknowledge that the Platform Providers (Apple, Google) have no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Warranty

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Ronny Majani does not warrant that the App will be error-free, uninterrupted, or free of harmful components, or that any calculations, plans, or outputs produced by the App will be accurate, complete, or suitable for any particular dive.

In the event of any failure of the App to conform to any applicable warranty, you may notify the applicable Platform Provider, and they may refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, the Platform Providers have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of the Developer.

Accuracy of Calculations

The App uses industry-standard algorithms (including Buhlmann ZHL-16C) and precision arithmetic to produce its calculations. However, no software can guarantee error-free results. Decompression models are mathematical approximations of complex physiological processes and do not account for all individual risk factors. Users must always verify critical dive planning data through multiple independent sources and should never treat the App's output as the sole basis for dive safety decisions.

Product Liability

The Developer, not the Platform Providers, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Limitation of Liability

To the maximum extent permitted by applicable law, Ronny Majani shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to personal injury, death, property damage, loss of data, or loss of profits — arising from or related to your use of or inability to use the App, any calculations or dive plans generated by the App, or any dive activities undertaken in reliance on information provided by the App, regardless of the theory of liability and even if Ronny Majani has been advised of the possibility of such damages.

Intellectual Property

The App, including its design, code, content, and branding, is owned by Ronny Majani and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

The Developer, not the Platform Providers, is solely responsible for the investigation, defense, settlement, and discharge of any intellectual property infringement claim relating to the App.

Export Compliance

By using the App, you represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree that you will not use the App for any purpose prohibited by U.S. or applicable local laws or regulations.

Third-Party Terms

You must comply with applicable third-party terms of agreement when using the App. For example, if the App uses your wireless data connection, you must not be in violation of your wireless data service agreement when using the App.

Third-Party Beneficiary

You acknowledge and agree that the Platform Providers (Apple Inc. and its subsidiaries; Google LLC and its subsidiaries) are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, the Platform Providers will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

Termination

This license is effective until terminated by you or the Developer. Your rights under this license will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and destroy any copies in your possession.

Changes to Terms

We reserve the right to modify this Agreement at any time. Continued use of the App after changes constitutes acceptance of the modified terms. We will update the "Last updated" date at the top of this page to reflect any changes.

Governing Law

This Agreement shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
